AGREEMENT TO OUR LEGAL TERMS
Welcome! We are Jazmo Intelligence Inc. ("Company," "we," "us," "our"). We operate the website vibelist.co (the "Site") and the mobile application Vibelist (the "App"), as well as any other related products and services that refer or link to these legal terms (collectively, the "Services").
These Legal Terms constitute a legally binding agreement between you ("you") and Jazmo Intelligence Inc. concerning your access to and use of the Services. By accessing the Services, you agree to be bound by all of these Legal Terms. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE IMMEDIATELY.
1. Our Services
Vibelist uses AI to generate personalized playlists based on your input and delivers them directly to your connected music service (Apple Music or Spotify).
All playlist suggestions and recommendations are generated by AI and are provided for entertainment purposes. We make no guarantees regarding the accuracy or suitability of the generated content.
2. Eligibility
To use the Service, you must be at least 13 years old and ensure your use adheres to all applicable laws. By using the Service, you represent that you meet these requirements.
3. User Accounts
When creating an account, you confirm that all information provided is truthful. You are responsible for safeguarding your account credentials and for all activity under your account. If you suspect unauthorized access, contact us at support@vibelist.co.
4. Intellectual Property
Our Intellectual Property
The Service, including its visual interfaces, graphics, design, software, and all other elements, is owned by Jazmo Intelligence Inc. and is protected by copyright and trademark laws. You may not make use of any Content except as expressly authorized.
Your Use of the Service
We grant you a non-exclusive, non-transferable, revocable license to install and use the App on a device you own, and to access the Service for personal, non-commercial use.
Your Feedback
If you provide feedback or suggestions, you grant us a perpetual, royalty-free right to use that feedback to improve the Service without any obligation for payment or attribution.
5. User Data
You retain all rights to the data you provide to the Service, such as your playlist prompts and preferences. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use your data for operating, maintaining, and improving the Service, including making your playlist prompts available to the Vibelist community so other users can discover and generate playlists from them. Your personal data is not attached to public prompts.

6. Purchases and Payment
Some features may require a subscription or in-app purchase. We reserve the right to modify pricing at any time. You will be notified of any changes before being charged.
7. Third-Party Services
Vibelist integrates with Apple Music and Spotify to deliver playlists. Your use of Apple Music is governed by Apple's own terms and conditions, and your use of Spotify is governed by Spotify's terms and conditions. We are not responsible for Apple Music's or Spotify's availability, content, or policies.
We use third-party AI models to generate playlists. AI outputs may be imperfect or unexpected. You are responsible for evaluating the appropriateness of generated playlists.
8. Prohibited Conduct
By using the Service, you agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse engineer, decompile, or extract the source code.
- Interfere with the Service's operation or security.
- Sell, resell, or transfer your access to the Service.
- Use automated tools to access or scrape the Service.
9. Disclaimers of Warranties
The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for all claims is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US$100.
11. Termination
We may terminate or suspend your access to the Service at any time, with or without cause or notice. You may terminate your account by contacting us at support@vibelist.co. Upon termination, your license rights will end and you must cease all use of the Service.
12. Changes to These Terms
We may update these Terms from time to time. For significant changes, we will notify you through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any legal action shall be brought exclusively in the courts located in San Francisco County, California.
